Terms of Service

These terms apply when you use WhirWhir. By making a video, buying credits or creating an account you agree to them, and to our Privacy Policy and Refund Policy. If you do not agree, please do not use the site. If something here is unclear, write to support@whirwhir.com before you buy.

What the service does

You upload a photo (or just describe a scene), pick an effect, and an AI video model creates a short video from it. Results are generated by AI: they will not always look exactly like the person in the photo or match the example clips, and two videos from the same photo can differ.

Who can use it

You must be at least 13 years old (or the higher minimum age required where you live) to use the service. If you are under the age of majority where you live, you need a parent's or guardian's permission to buy credits or a plan. You are responsible for what happens under your account, so keep your password private and tell us if you notice anything you did not do.

Credits and payments

• Videos are paid for with credits. The credits a video needs are shown on the button before you start it, and they are taken only when the video starts.
• If a video fails, times out, or is blocked by the safety check (before or after it is made), the credits are returned to your balance automatically. A video that is finished but that you don't like is not a failed video.
• Credit packs never expire. Credits included in a monthly or yearly plan are for that billing period and expire at its end; unused plan credits do not roll over.
• Pack and plan credits share one balance. The credits that expire soonest are used first.
• Plans renew automatically at the price shown when you subscribed until you cancel. By subscribing you allow us, through Stripe or PayPal, to charge your payment method at the start of each billing period. You can cancel at any time in Billing; no further charges are made after you cancel, and credits you already received stay usable until they expire.
• Prices are shown on the Pricing page, in your local currency where available. Prices and offers may change; the price shown at checkout applies. Payments are processed by Stripe or PayPal.
• You can buy and make a video without an account. A guest's video and the photos used for it are deleted 3 days after the video is finished; sign in with the email you paid with to keep them.
• Credits cannot be transferred to another account or exchanged for cash, except as described in our Refund Policy.

Photos you may upload

Only upload photos that you took yourself or have the right to use, of yourself or of people who have agreed to be in the video. You may not upload or ask for:

• Photos of celebrities, public figures or any other person without their consent, or videos meant to impersonate or mislead people about a real person.
• Photos of anyone under 18, unless you are their parent or legal guardian or have their parent's or guardian's consent.
• Any sexual or suggestive content involving a minor, or anyone who appears to be one.
• Nudity, sexual content, violence, hate, or content that harasses or bullies anyone.
• Content that infringes someone else's copyright, trademark or other rights.
• Anything illegal where you live or where the video will be shown.

Your text, your photos and the finished video each pass an automatic safety check. We may refuse a photo or a request, remove videos that break these rules, and close accounts that repeatedly break them; credits already used are not returned in that case. If you see a video made on this site that uses your likeness without your consent, write to support@whirwhir.com and we will remove it.

Using the site fairly

You may not:

• Try to get around the safety checks, rate limits or other limits, for example by rewording a blocked request or using several accounts.
• Probe, overload, scrape or interfere with the site or the AI providers behind it.
• Use the site for fraud, or pay with payment details that are not yours.

Your videos

• You own the videos you make, as far as the law allows, and you may use them for personal and commercial purposes, including posting them on social media.
• You keep all rights to the photos you upload. You give us permission to store them, send them to our video providers and process them only to make and deliver your videos. We do not use them to train AI models.
• AI models can make similar videos for different people, so we cannot promise that your video is unique. Make sure your use does not infringe anyone else's rights.
• You are responsible for how you use and share your videos, including following the rules of the platforms where you post them.
• To delete a video or photo, write to support@whirwhir.com; deleting your account removes all of them at once.
• Song titles and artist names on effect pages only describe a dance or trend. This site is not affiliated with those artists, and the videos do not include the original music.

Our content

The site, its design, the example videos and the effect descriptions belong to us or our licensors. Please do not copy them in bulk or use automated tools to scrape the site.

Availability

We run the service on a best-effort basis. We do not promise that it will always be available, how fast a video will be ready, or that any effect or model will stay on offer. Generation can be slow or temporarily unavailable when AI providers are busy. We may add, change or remove effects, models and features. If we ever close the service, we will tell you in advance so you can download your videos.

Disclaimers and liability

The service is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose and non-infringement. To the extent the law allows, we are not responsible for indirect, incidental or consequential losses, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

Ending your account

You can delete your account at any time in your account settings; if you have a plan, cancel it in Billing to stop renewals. We may suspend or close an account that breaks these terms, uses stolen payment details, abuses the service, or puts other people or people shown in videos at risk; in that case unused credits from fraudulent payments are removed. Opening a chargeback or payment dispute suspends the account, removes its unused credits and cancels any plan, so please write to us first.

The sections on photos you may upload, using the site fairly, your videos, and disclaimers and liability still apply after an account is closed.

Changes to these terms

When we change these terms we update the date at the top of this page. Important changes will be announced by email or on the site before they apply. Using the service after that means you accept the new terms.
